This Privacy Policy describes how ferminfleites.com (the “Site”), operated by Fleites Atelier, the studio of visual artist Fermin Fleites (“we”, “us”, “our”), collects, uses, discloses and protects your personal information when you visit the Site or contact us. The Site is published for portfolio, exhibition and art-inquiry purposes.
1. Information you provide directly
When you use our contact forms or email us, we collect:
- Name (or first and last name, depending on the form)
- Email address
- Phone number
- The content of your message, including any details you choose to share about artworks, exhibitions, commissions or press requests
- Your IP address, browser identification (user agent) and the page you wrote from, which the contact form stores automatically with each message
We collect this information solely to respond to you. Providing it is voluntary; if you do not provide contact details we simply cannot reply.
2. Information collected automatically
Like most websites, the Site collects information automatically when you browse:
- Google Analytics 4 (installed via Site Kit): pages viewed, links and buttons clicked, referral source, browser and device type, approximate location (city/region) and IP address as processed by Google. Cookies used: _ga and _ga_BQV66E814D.
- Google reCAPTCHA v3, used to protect our forms from spam and abuse. It processes your IP address and interaction data in accordance with Google’s policies.
- Security and performance data: our host and CDN (Hostinger) and our caching layer may log IP address, requested URL and timestamps for security and delivery purposes.
- On most pages, scripts are loaded with delay on first interaction, so most third-party services are activated only after you begin using the Site.
3. How we use your information
We use the information described above to:
- Respond to your inquiries and communicate with you about artworks, exhibitions, commissions, licensing or press;
- Operate, secure, maintain and improve the Site;
- Detect and prevent spam, fraud and abuse;
- Comply with applicable law.
4. Cookies and how to control them
The Site uses the following first-party measurement cookies:
- _ga: Distinguishes users for Google Analytics. Duration: 2 years.
- _ga_BQV66E814D: Maintains session state for Google Analytics. Duration: 2 years.
The live chat widget (Formilla) also stores a visitor identifier, formillaVisitorGuid, in a cookie or in your browser’s local storage.
We do not currently operate a cookie banner. You can control cookies at any time through your browser settings, and you can opt out of Google Analytics with Google’s Analytics Opt-out Browser Add-on. Google also explains its own use of cookies at policies.google.com/technologies/cookies.
Do Not Track: there is no uniform standard for responding to Do Not Track signals, and the Site does not currently respond to them.
5. Third-party services
The following third parties may process information in connection with the Site. We do not control their practices; please review their policies:
- Google Analytics 4 (Google LLC): Traffic measurement and analytics
- Google reCAPTCHA (Google LLC): Spam and abuse protection on forms
- Formilla live chat (Formilla, Inc.): Optional live chat widget (message content and identifiers)
- Buttonizer (Buttonizer B.V.): The floating INDEX menu; it also loads the chat widget and its icons, and counts clicks on its buttons
- YouTube embed (Google LLC): Video player, loaded only when you click play
- Font Awesome (cdnjs) (Cloudflare, Inc.): Font and icon delivery
- Hosting / CDN (Hostinger): Site delivery and security logs
- Gmail (Google LLC): Delivers contact-form messages to our inbox
Links to other websites: the Site links to third-party websites (including social media and partner pages). We are not responsible for their content or privacy practices.
6. Sale and sharing of personal information
We do not sell your personal information for money, and we do not share it for cross-context behavioral advertising. We do not run targeted advertising or remarketing on the Site.
7. Your privacy rights
California residents. Under the California Consumer Privacy Act, as amended by the CPRA, you may request to know the personal information we hold about you, delete it, correct it, opt out of any sale or sharing, and exercise your rights without discrimination. To submit a request, use the contact form on the Site. We may need to verify your identity before completing a request, and you may use an authorized agent.
Residents of other U.S. states. Colorado, Virginia, Connecticut, Utah, Texas and a growing number of other states have enacted comparable privacy laws. We will honor reasonable requests from residents of any U.S. state through the same channel.
European Economic Area and UK residents. If you access the Site from Europe, you may request access to, rectification, erasure, restriction of, or objection to our processing of your data, and you may request portability. Our lawful basis is our legitimate interest in responding to your communications and operating the Site. You may also lodge a complaint with your local supervisory authority.
8. Children’s privacy
The Site is not directed to children under 13, and we do not knowingly collect personal information from children under 13, consistent with the Children’s Online Privacy Protection Act (COPPA). If you believe a child has provided us with information, contact us and we will delete it.
9. Email communications
The Site does not currently operate a newsletter or send marketing email. If we ever do, every commercial message will identify us accurately, include our physical mailing address, and provide a clear way to unsubscribe, as required by the CAN-SPAM Act.
10. Data retention and security
We retain personal information for as long as necessary to respond to your inquiry and to maintain our professional correspondence, after which it is deleted or anonymized. We use reasonable technical measures (HTTPS, access controls, spam protection), but no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. Changes to this policy
We may update this Privacy Policy from time to time. The “Effective date” at the top identifies the latest version. Continued use of the Site after changes constitutes acceptance of the revised policy.
